Law to curb illegal activity in the construction industry according to §48b EstG/construction withholding tax.

In the construction industry, a new tax deduction procedure was introduced by the law to curb illegal activity in the construction industry. It obliges clients of construction services to deduct 15 % from the invoices they receive from their contractors and to pay it to the tax office as of 1 January 2002.

The law covers companies that are directly commissioned to carry out construction work as defined in § 1 and 2 of the Construction Work Ordinance.

As a supplier of building materials, Sto SE & Co. KGaA and StoCretec GmbH do not provide any construction services listed in the Construction Operations Ordinance and are therefore not affected by the law. It is therefore not necessary to issue exemption certificates, as some customers have already requested from us.
